What is the FMCSA Clearinghouse?

The Federal Clearinghouse is a secure online database that gives the Federal Motor Carrier Safety Administration (FMCSA), employers, and enforcement agencies access to real-time information about CDL drivers’ drug and alcohol program violations.

It was created to improve road safety by ensuring that drivers with substance use violations cannot operate commercial vehicles until they complete the return-to-duty process.

The FMCSA Clearinghouse went into effect on January 6, 2020.

All CDL employers and drivers are required to register.

Frequently asked questions

What is the FMCSA Clearinghouse?

The FMCSA Clearinghouse is an online database that monitors drug & alcohol program compliance and violations. It aims to enhance road safety, preventing accidents on the road. The system can be used by employers, drivers, and service agents to report and monitor testing procedures and results.

Who is required to register within the Clearinghouse?

Clearinghouse is obligatory for employers who hire commercial drivers, truck drivers themselves, medical review officers, substance abuse professionals, and third-party administrators. They must report any drug or alcohol violations.

How can I maintain Clearinghouse compliance?

Maintaining clearinghouse compliance requires thoroughly managing your business’s drug and alcohol program. This involves conducting all required tests and reporting results or refusals to test. In addition, it’s important to update your status, including drivers and company information current.

What are the consequences of non-compliance with Clearinghouse?

Violations of the Clearinghouse regulations can lead to fines, the potential loss of operating authority, or legal actions. It may also involve increased attention from authorities and more frequent audits.

How often should I audit the compliance of the Drug and Alcohol Program?

The FMCSA recommends to conduct audits annually to ensure all aspects are met. In addition, more frequent audits can be necessary depending on the size of your operations.

The audits should include a review of your clearinghouse records and status, testing procedures, and reporting practices.

Can drivers check their Clearinghouse status?

Yes, drivers can access their own status. To do so, they should log into their personal account on the FMCSA Clearinghouse portal. There, drivers can view any reported violations, check the results of drug or alcohol testing, and monitor their compliance history. It’s important to stay informed on the clearinghouse status and ensure prompt addressing of any issues.
